Terms of Service

1. Acceptance of Terms
By accessing or using the bhuru platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). You must be at least 18 years of age to use this Service. If you do not agree to these Terms or are under 18 years of age, you may not use the Service. These Terms apply to all users, including guests and registered users.
2. Description of Service
bhuru is a fintech utility payments platform that enables users to purchase ZESA electricity tokens, airtime top-ups, data bundles, and third-party insurance in Zimbabwe. Payments are collected through Paynow or EcoCash Direct; service fulfillment is handled by the respective service providers (ZETDC, mobile networks, TelOne, and insurance providers).
3. User Responsibilities
- You are responsible for providing accurate information, including phone numbers, meter numbers, and vehicle registration details.
- You must ensure you have sufficient funds in your payment method before initiating a transaction.
- You are responsible for the security of your account credentials if you choose to register.
- You must not use the Service for any unlawful purpose or in violation of any applicable laws in Zimbabwe.
- You must not attempt to circumvent any security measures or rate limits on the platform.
- We reserve the right to refuse processing any transaction, or suspend/terminate your account without prior notice, if we suspect the transaction is fraudulent, violates anti-money laundering regulations, or breaches these Terms.
4. Payment Terms
Transactions are processed in real time through Paynow or EcoCash Direct. By initiating a payment, you authorise bhuru and your mobile money provider (e.g., EcoCash or OneMoney) to debit your selected wallet for the specified amount.
- Prices are displayed in USD or ZIG depending on your currency preference. Exchange rates are sourced from the Reserve Bank of Zimbabwe (RBZ) and locked for 10 minutes at the time of transaction initiation.
- Service fees, where applicable, are displayed as a separate line item before payment confirmation.
- Transactions are final once payment is confirmed. Refunds are subject to the Refund Policy below.
5. Refund Policy
bhuru will process refunds in the following circumstances:
- Failed service delivery: If your payment is confirmed but the service (e.g. ZESA token, airtime) is not delivered within the expected timeframe, bhuru will attempt an automatic reversal. If the reversal fails, a manual refund will be processed within 5 business days.
- Duplicate transactions: If you are charged twice for the same transaction due to a technical error, the duplicate charge will be refunded.
- Incorrect meter/account number:Refunds for transactions processed to an incorrect meter or account number are subject to the service provider's reversal policy. Not all providers support reversals.
- Gifts (declined, unclaimed, or unfulfillable): Funds sent as a gift that are declined by the recipient, that cannot be fulfilled, or that remain unclaimed are refunded to the original payer's payment method less a 10% administrative fee, which covers non-recoverable payment processing costs. Unclaimed gifts are held for thirty (30) days from the date the gift was funded before this refund is processed; declined or unfulfillable gifts are refunded promptly. Gifts that are successfully delivered or claimed are final and subject to the standard refund circumstances above.
To request a refund, contact us with your transaction reference number (MW-YYYY-XXXXXX). Refunds are processed to the original payment method. You must report any transaction disputes or refund requests within thirty (30) days of the transaction date. bhuru reserves the right to decline investigations or refunds for disputes raised outside of this period.
6. Limitation of Liability
bhuru is a payment facilitation platform. We are not responsible for service delivery failures caused by third-party providers (ZETDC, mobile networks, TelOne, insurance providers, or EcoCash). Our liability is limited to the amount of the transaction in question. We are not liable for any indirect, incidental, or consequential damages arising from the use of the Service.
7. Gifting & Rewards Points
bhuru lets you pay for a service (such as ZESA, airtime, or data) on behalf of another person as a gift, sent to their bhuru tag, payment link, or QR code. A gift is a closed-loop payment: it can only ever pay for a service and can never be withdrawn as cash. Payment is collected at the time the gift is sent, and the service is then delivered to the recipient or claimed by them. Refunds of declined, unclaimed, or unfulfillable gifts are governed by the Refund Policy in Section 5.
Registered users earn rewards points on eligible transactions. The following terms apply to points:
- Points are earned at a rate set by bhuru (1% of the amount paid by default) on the portion of a transaction paid in money, and are calculated in whole points only. One point is equal to one United States cent (US$0.01). Transactions paid in ZiG are converted to USD at the prevailing exchange rate before points are calculated.
- Points have no cash value; they are not money, e-money, or a deposit, and cannot be exchanged for cash, transferred, or sold. They may be redeemed only for services on the bhuru platform, including to pay part or all of a transaction.
- Points expire after twelve (12) months without any points activity (earning or redeeming) on your account.
- bhuru may reverse points issued for a transaction that is later refunded, and may adjust, withhold, or cancel points, or suspend the rewards programme, in the event of error, fraud, abuse, or closure of your account.
- The rewards programme is available to registered users only. bhuru may change the earn rate, redemption rules, or these terms at any time, with notice posted on this page.
8. Service Availability
We strive to maintain 24/7 availability but cannot guarantee uninterrupted service. Scheduled maintenance, third-party outages, or force majeure events may cause temporary unavailability. We will communicate planned downtime where possible.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the new Terms.
10. Governing Law
These Terms are governed by the laws of Zimbabwe. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.
